Palmetto Pro Turf LLC – Terms & Conditions
Section 1: Services & Scope of Work
1.1 Recurring Lawn Maintenance – What Is Included
Recurring lawn maintenance services generally include, unless otherwise stated in the customer’s approved estimate:

Mowing of turf areas

Trimming of areas not accessible by a mower

Edging of walkways and driveways every other scheduled service

Blowing of loose debris generated by the service from hard surfaces
Vertical obstructions such as fences, planters, bird feeders, trampolines, swing sets, and similar items may have non‑selective herbicide applied around their base to reduce the risk of damage from mowing or trimming directly against them.

1.2 Services Not Included in Recurring Lawn Maintenance
Unless specifically listed in the approved estimate, recurring lawn maintenance does not include:

Flower bed maintenance

Removal or blowing of debris buildup not generated by the current service

Picking up sticks, limbs, or debris prior to service

Hauling away or removing material not brought to the property by Palmetto Pro Turf LLC

Moving or relocating obstructions, including trampolines, benches, planters, excess toys, hoses, or garden tools
Debris such as bush clippings, piles of sticks, leaves originating from beds or wooded areas may be mowed over or avoided based on quantity and the impact on turf appearance. Removal of such debris is available only upon request and with an approved estimate.

1.3 Mowing Height, Turf Conditions, Weather Impacts & Overgrown Lawns
Mowing height is based on best practices for the healthiest turf maintenance. Equipment is maintained for optimal performance; however, uneven terrain, slopes, soft soils, or weather‑related conditions (including rain‑saturated ground) may cause unavoidable scalping, rutting, or light turf disturbance.
Minor turf damage caused by soil, weather, or terrain is considered a normal risk of maintenance and is not grounds for service adjustment, repair, or reimbursement. Permanent correction may require grading, leveling, drainage improvements, or soil amendments.
For new clients, if the initial service reveals the lawn is overgrown or contains excessive debris, the service will still be completed and charged as an initial cleanup. During leaf‑fall season, unless a dedicated leaf cleanup service is scheduled, leaves and debris will be mulched during regular mowing and will not be removed.

1.4 Weed Control & Fertilization Programs
Weed control and fertilization programs typically include four (4) applications per year, or more depending on program design, and may include both pre‑emergent and post‑emergent treatments.
Services not included unless specified: aeration, overseeding, insecticide applications to turf, beds, or hedges, and applications to established flower beds. Palmetto Pro Turf LLC does not offer natural, organic, or “green” chemical alternatives unless listed in the approved estimate.
1.5 Mulch & Pine Straw Installation
Includes:

1–2 inches of mulch where existing mulch is present
-
3–5 inches of mulch where bare ground exists
-
Application of granular pre‑emergent herbicide
Landscape fabric or weed barrier is not included unless specifically requested.

1.6 Hedge Trimming & Ornamental Pruning
Recurring hedge trimming for shape maintenance includes chopping/dispersing clippings. Large debris will be collected where feasible; remaining fine debris will break down naturally.
Bloom retention is not guaranteed. Crape myrtles are pruned by default, not “topped.” Ornamental trees are pruned to remove dead or misdirected growth, with a target reduction of 10–15% for plant health.
1.7 Property Cleanups
Billed at a minimum of $2.00 per minute due to the unpredictable nature of cleanup work, which may include multiple mowing passes, trimming, debris collection, and material removal.
1.8 Recurring Bed Maintenance
May include four (4) applications of pre/post-emergent herbicides, manual weed removal, and monthly spot spraying.
1.9 Residential vs. Commercial Application
These service descriptions generally apply to residential clients. Commercial clients may have specific scopes defined in their contracts or estimates.
Section 2: Scheduling, Routes & Weather Delays

2.1 Service Routes & Scheduled Days
Clients are assigned target service days (Monday, Tuesday, etc.). Days may change due to weather, projects, staffing, or route optimization. Palmetto Pro Turf LLC aims to maintain service within plus or minus one (1) day of the assigned route.
2.2 Weather Delays & Ground Conditions
Service may be delayed to prevent turf damage. Delays do not reduce service charges. Delayed services may require additional time or passes at the next visit.
2.3 Skipped or Delayed Services & Billing
If service cannot be completed due to factors outside Palmetto Pro Turf LLC’s control, no billing adjustment will be made. The client will be billed for both the delayed service and the subsequent scheduled service. If Palmetto Pro Turf LLC causes the missed service, it will not be billed.
2.4 Access Requirements
Clients must provide unobstructed access to all service areas, including gates, codes, and pets. Restricted access will result in skipped areas, but service charges will not be adjusted.
2.5 Seasonal Frequency Adjustments
Service frequency may vary seasonally based on turf growth patterns. Weekly clients may transition between weekly, bi‑weekly, or alternative schedules during periods of slower growth.
Off‑season services may include reduced mowing frequency and/or periodic property checks or maintenance visits. Seasonal adjustments do not reduce the overall scope of maintenance required and do not constitute a suspension or cancellation of service unless agreed to in writing.
Specific seasonal service expectations may be outlined in the approved estimate or communicated separately.
2.6 Seasonal Mowing Expectations
Regular mowing services are performed during periods of active turf growth, which generally occur during the spring through fall, depending on weather conditions, rainfall, temperature, and turf type.
During periods of reduced or dormant growth, mowing frequency may be reduced, suspended, or transitioned to alternative maintenance services as outlined in the approved estimate or seasonal service plan.
Billing is based on the contracted scope of service and seasonal maintenance expectations, not solely on the number of mowing visits performed.
Section 3: Customer Responsibilities & Property Conditions
3.1 Irrigation, Utilities & Obstructions
Customers must identify, mark, or disclose any visible or unavoidable obstructions. Temporary items must be disclosed and/or marked. Undisclosed items damaged during normal service are not the responsibility of Palmetto Pro Turf LLC; any required corrective work will be billed to the customer.
3.2 Pre‑Existing Conditions
Palmetto Pro Turf LLC is not responsible for pre-existing turf damage, diseased plants, soil issues, or damaged hardscape or irrigation components.
3.3 Property Condition & Site Coordination
Customers must maintain safe property conditions and notify Palmetto Pro Turf LLC of other service providers (plumbing, irrigation, pest control, construction). Wet or soft soil increases turf disturbance risk; customers acknowledge and accept these risks.
3.4 Notification of Issues
Concerns regarding service quality, damage, or missed areas must be reported in writing within a reasonable timeframe.
Section 4: Billing & Payments
4.1 Billing Schedule
Billing is conducted during the first week of each month for that month’s services. Prepayment for multiple months is allowed if arranged in advance.
4.2 Payment Methods
The default payment method is charging the credit or debit card on file. Alternative payment methods include cash, check, or online payment via invoice link for one-time/non-recurring services. If payment is not received via cash or check when Palmetto Pro Turf LLC arrives for service, the card on file will be charged prior to service.
4.3 Residential Accounts
All residential accounts require a card on file before services can begin.
4.4 Invoice Disputes
Invoices are due upon receipt. Disputes must be emailed to help@palmettoproturf.com with the subject line “Invoice Dispute” within 30 days of receipt. Any billing corrections will be credited to the client’s account rather than refunded, unless explicitly agreed in writing.
4.5 Updating Payment Information
Clients may update card information at any time using the link provided on invoices/receipts. Declined cards may incur a $25 fee per occurrence.
4.6 Late Payments
Payments not received by the next billing cycle will result in suspension of services until payment is made. A late fee of 1.5% per month (or $25 minimum) may apply, along with any associated bank fees.
Section 5: Property & Site Considerations
5.1 Client Property Access
Clients are responsible for clearing access and notifying of obstructions, pets, or hazards.
5.2 Landscaping & Hardscape Care
Palmetto Pro Turf LLC is not responsible for pre-existing damage to landscaping, hardscape, or irrigation components.
5.3 Seasonal & Safety Considerations
Service may be modified to reduce risk to turf, plants, or property during adverse weather or unsafe conditions.
5.4 Hardscape, Vehicles & Personal Property
Palmetto Pro Turf LLC generally avoids mowing or trimming within approximately three (3) feet of vehicles not normally parked in service areas. If turf cannot reasonably be skipped, mowing or trimming may proceed. Customers are encouraged to move vehicles prior to service. Palmetto Pro Turf LLC is not responsible for incidental damage near vehicles not relocated.
5.5 Third-Party Service Providers
Palmetto Pro Turf LLC is not responsible for damage, delays, or service interruptions caused by other contractors, utility companies, or third-party service providers. Customers must notify Palmetto Pro Turf LLC of third-party work in advance. If service cannot be performed due to third-party presence, undisclosed site conditions, or lack of access, no billing adjustment will be made.
5.6 Limitation of Liability
Palmetto Pro Turf LLC’s liability for any claim arising from services provided is limited to the total amount paid by the client for the affected service. Palmetto Pro Turf LLC is not liable for indirect or consequential damages.
5.7 Indemnification
Clients agree to indemnify and hold harmless Palmetto Pro Turf LLC from claims, damages, or costs resulting from pre-existing conditions, undisclosed hazards, or third-party actions.

Section 6: Service Changes & Termination
6.1 Service Changes
Clients may request modifications to service scope or type. Requests must be submitted in writing and approved by Palmetto Pro Turf LLC.
6.2 Termination by Client
Clients may terminate services with seven (7) days written notice. Termination does not relieve the client of payment for services already performed. Final invoices will be sent within one full billing cycle.
6.3 Termination by Palmetto Pro Turf LLC
Palmetto Pro Turf LLC may terminate services with seven (7) days written notice for: overdue payment, unsafe conditions, non-compliance with T&C, or any other reason deemed appropriate. Services provided prior to termination are billed in full; prepaid services may be credited at Palmetto Pro Turf LLC’s discretion.
Section 7: Communication, Notices & Authorization
7.1 Authorized Contacts
All communications must be directed to individuals named on the account or formally designated in writing.
7.2 Preferred Methods of Communication
Email is preferred. Text messages are acceptable for general communication. Service changes, billing disputes, and terminations should be made by phone or email.
7.3 Legally Binding Communications
Written communications (email or letter) from authorized contacts are legally binding. Service requests, disputes, and terminations must be submitted in writing to be effective.

Section 8: Legal Provisions
8.1 Governing Law
This Agreement is governed by South Carolina law. Legal actions shall be filed in Anderson County, South Carolina.
8.2 Dispute Resolution
Disputes will first be attempted to be resolved via good faith negotiation. If unresolved, mediation may be used. Failing resolution, disputes may be filed in Anderson County courts.
8.3 Entire Agreement
This Agreement and approved estimates constitute the full understanding between parties; prior agreements or verbal promises are not valid unless incorporated herein.
8.4 Amendments
Changes must be made in writing and signed by both Palmetto Pro Turf LLC and the client.
8.5 Severability
If any provision is invalid or unenforceable, remaining provisions remain in full effect.
8.6 Waiver
Failure to enforce any term does not waive the right to enforce it in the future.
8.7 Amendments to Terms & Conditions
Palmetto Pro Turf LLC reserves the right to update, modify, or amend these Terms & Conditions at any time. Updated versions will be provided to clients in writing or electronically, and continued use of services after notification constitutes acceptance of the revised Terms & Conditions.
Section 9: Acceptance & Effective Date

These Terms & Conditions are effective as of January 1, 2026, and supersede all prior version.
